Terms of service
The agreement
These terms are a contract between you and IntentiveAI, the operator of Our Family Talking ("we", "us"). They apply to the ourfamilytalking.com website and the Our Family Talking application (together, "the service"). By creating an account or using the service you agree to these terms and to our privacy policy. If a court order directs you to use the service, the order governs how you must use it with your co-parent; these terms govern your relationship with us.
Who can use the service
You must be at least 18 years old and have a lawful reason to communicate with the other parent or guardian on a case. Professionals (attorneys, mediators, custody evaluators, therapists, and similar) may use the service with the access a parent or a court grants them. One person per account: do not share your password, and do not sign in as anyone else. You are responsible for everything posted from your account.
What the service does
Our Family Talking keeps a time-stamped record of communication between co-parents (messages, attachments, calendar entries and change requests, expense requests and receipts, and information-bank entries) and lets you export certified copies of it. We keep the original record on our systems, we issue a record identifier and digest for every export, and we operate a public page where anyone holding a record identifier can check whether a PDF matches the copy we generated.
What the service does not do
- It does not give legal advice and is not a law firm. Talk to a lawyer about your case.
- It does not monitor conversations. Nobody at IntentiveAI and no court reads your messages as they are sent.
- It is not an emergency channel. If a child or anyone else is in danger, call 911. Keep a separate way to reach your co-parent in an emergency.
- It does not decide what a court will accept. Whether an export is admitted, authenticated, or treated as a business record is for the court.
The record
Sent messages become part of the case record and stay there. With a paid subscription or a fee waiver, you can edit a message you sent for 2 minutes after sending, up to 3 times, and only until anyone else on the case sees it; after that it cannot be changed. Editing sent messages is not part of the free trial. An edited message is marked as edited for everyone on the case, and every version, including the original, stays in the record and in certified exports. Calendar and information-bank entries can be updated, and every earlier version stays on the record. The service checks the tone of a message before it sends and may show you a warning or a suggested rewrite; the warning is shown only to you and is never part of the record. Profanity that the check blocks is never sent and never stored.
Professional and court access
A parent can grant a professional read-only access to a case, and either parent can revoke a grant they made. Where an administrator records a grant as ordered by a court, parents cannot revoke it. Professionals may export certified records, and every time a professional reads message content it is logged where both parents can see it.
Subscriptions and payment
Subscriptions are per parent and are billed monthly or annually at the prices shown on the pricing page. Every new account starts with a free trial that needs no card. One parent may pay for the other. Payments are processed by our payment processor; we do not see or store card numbers.
Renewal and cancellation. Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from your billing settings; a monthly plan stays active until the end of the month you paid for, and an annual plan until the end of the year you paid for. Except where the law requires otherwise, payments are not refunded for partial periods.
Price changes. We will email you at least 30 days before a price change takes effect on your subscription.
Fee waivers. We waive or reduce fees for parents facing financial hardship and for parents in domestic-violence situations. Write to support@ourfamilytalking.com.
If you stop paying, your account becomes read-only. You keep your sign-in, you can read everything on the case, and you can export unlimited certified records. You cannot post until a subscription, trial, or waiver is active again. Your record is never withheld for non-payment.
Your content
You own what you post. You give us the permission we need to store it, show it to the people the case authorizes, include it in exports, and back it up, for as long as the record exists. You are responsible for having the right to post what you post, including attachments and information about other people. The service, its design, and its software belong to IntentiveAI; these terms give you a personal, non-transferable right to use the service and nothing more.
Acceptable use
Do not use the service to harass, threaten, or stalk anyone, to violate a court order, to impersonate anyone, to upload malicious files, to interfere with the service or other people's use of it, or to post content you have no right to share. We may suspend or close an account that does. Suspension does not delete the record: the other parent's access and the ability to export continue.
Preservation and disclosure
We preserve and disclose records when a valid subpoena, court order, or other legal process requires it, and when we believe in good faith that doing so is necessary to protect the safety of a child or another person. Our privacy policy describes how we handle those requests.
Ending your account
You can ask us to close your account at any time. Because the other parent's record depends on the shared case, case content stays in place while another active member remains on it; the privacy policy explains the retention rules. We may close an account for a breach of these terms or where the law requires it, and we will tell you why unless the law prevents us.
Availability, warranties, and liability
We work to keep the service available at all times and to keep the record complete, but the service is provided "as is" and we do not promise uninterrupted availability or that it will be free of errors. To the fullest extent the law allows, we disclaim implied warranties, including merchantability and fitness for a particular purpose.
To the fullest extent the law allows, IntentiveAI is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from the service, and our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow these limits, so they may not apply to you in full.
Disputes and governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. If you have a dispute with us, write to us first and we will try to resolve it within 30 days. Any dispute that is not resolved will be heard in the state or federal courts located in California, and you and we consent to their jurisdiction. Nothing in these terms limits your right to bring a claim in small-claims court or your rights under laws that cannot be waived by contract.
Changes to these terms
When we change these terms we post the new version here with a new effective date, and we email account holders at least 30 days before a material change takes effect. Continuing to use the service after that date means you accept the new terms. If you do not, close your account before the change takes effect; your export rights continue regardless.
General
These terms and the privacy policy are the entire agreement between you and us about the service. If a part of them is found unenforceable, the rest still applies. You may not transfer your account or these terms to anyone else. We may assign this agreement to a successor that takes over the service, and we will tell you if that happens.
